Short answer: can you sell a house with tenants in Madison, WI?

Yes. In Wisconsin a sale does not end a lease: the buyer takes the property subject to the tenant's rights and steps into your shoes as landlord (Wis. Stat. § 704.09(3)). You can show the home with at least 12 hours' advance notice (ATCP 134.09(2)(a)), and if you want it empty, a month-to-month tenancy needs at least 28 days' written notice (Wis. Stat. § 704.19(3)). Your real choice is who you sell to: an investor who wants the rent, an owner-occupant who wants it vacant, or a direct cash buyer.

I'm Kyle Ristow with Luxe Haven Real Estate Group. Here is how selling a house with tenants in Madison actually works, the Wisconsin rules that matter, and how to pick the path that nets you the most with the least drama.

Why selling a rented house in Madison is its own kind of sale

Madison is a renter-heavy city. The City of Madison reports that in 2023, just over half of its roughly 126,000 households (53%) rented their homes (City of Madison, "Who Lives in Madison?"). So a lot of the duplexes, two-flats and single-family homes that come up for sale here have someone living in them under a lease.

The market is still healthy for sellers. In September 2026 the median Madison home sold for $439,791, up 4.7% from a year earlier, homes sold at 100.1% of list price on average, and the median time on market was 50 days, six days longer than in 2025 (Redfin, Madison housing market, September 2026). Buyers are there, but they are taking a little longer, and a tenant-occupied home has to be marketed with that in mind.

The Wisconsin rules for selling a house with tenants

The lease goes with the house

Lease terms that are not personal to the original parties are "enforceable by or against the successors in interest" (Wis. Stat. § 704.09(3)). The Wisconsin REALTORS® Association puts it plainly: the sale of a property does not terminate a lease or rental agreement, and the new owner must step into the seller's shoes (WRA Legal Hotline). The standard WB-11 offer even says occupancy is given "subject to tenant's rights, if any."

Showings need notice

Wisconsin lets a landlord show the premises to prospective purchasers "upon advance notice and at reasonable times" (Wis. Stat. § 704.05(2)). The state's rental rule defines advance notice as at least 12 hours unless the tenant agrees to a shorter time (ATCP 134.09(2)(a)). A simple fix is to batch showings into a few set windows each week so your tenant isn't fielding requests every day.

Ending a month-to-month tenancy

If you'd rather sell vacant and the tenant is month-to-month, you need at least 28 days' notice, and the date should line up with the end of a rental period (Wis. Stat. § 704.19(3) and (5)). A fixed-term lease generally runs to its end date unless the tenant agrees otherwise in writing.

The security deposit

The new owner has to honor the tenant's rights, including the return of the security deposit (WRA), and deposits must be returned within 21 days after the tenancy ends (ATCP 134.06(2)). Make sure every deposit is accounted for and credited at closing so it doesn't come back to you later.

This is general information, not legal advice. For a lease dispute or an unusual lease clause, talk with a Wisconsin real estate attorney.

Three ways to sell a house with tenants in Madison

1. Sell it occupied to an investor

Investors buy for the rent. A signed lease, on-time payment history and below-market rent with room to grow can all add value. You'll want a clean rent roll, copies of every lease, deposit amounts and the last 12 months of income and expenses ready before you list.

2. Wait for the lease to end and sell vacant

An empty, freshly cleaned home opens the door to owner-occupant buyers, including buyers who want to live in one unit of a duplex and rent the other. That is usually the biggest buyer pool, but you carry the mortgage, taxes and utilities while it sits empty.

3. Take a direct as-is cash offer

If the house needs work, the timing is tight, or you just want to be done being a landlord, you can request a direct as-is cash offer from us: no repairs, no showings, and you pick the closing date. Tell us about the leases up front so the offer reflects them. You'll usually net less than a full-market sale, which is why I put both numbers in front of you side by side.

A seller's checklist for a tenant-occupied Madison home

  • Read every lease for the end date, renewal terms and any clause about sale or showings.
  • Gather the rent roll, deposit records and any move-in condition notes.
  • Talk to your tenant early. A cooperative tenant makes showings, photos and inspections far easier.
  • Agree on showing windows and give written notice of at least 12 hours each time.
  • Budget for Wisconsin's real estate transfer fee of $3 per $1,000 of value, which the seller normally pays (Wis. Stat. § 77.22).
  • Line up deposit and prorated-rent credits for closing, and send tenants a written notice with the new owner's contact information after closing.

Selling a house with tenants in Madison: FAQs

Can I sell my Madison house while a tenant has a lease?

Yes. In Wisconsin the lease stays in force after the sale and the buyer becomes the new landlord under Wis. Stat. § 704.09(3). The tenant does not have to move just because the house sold.

How much notice do I give my tenant before a showing in Wisconsin?

At least 12 hours' advance notice, at a reasonable time, unless the tenant agrees to a shorter time (ATCP 134.09(2)(a); Wis. Stat. § 704.05(2)).

Do I have to end a month-to-month tenancy before selling?

No. You can sell with the tenant in place. If you choose to end it, Wisconsin requires at least 28 days' written notice, timed to the end of a rental period (Wis. Stat. § 704.19(3)).

What happens to the tenant's security deposit when I sell?

The buyer takes over the obligation to return it, so the deposit is transferred or credited to the buyer at closing under the purchase contract. The deposit must be returned within 21 days after the tenancy ends (ATCP 134.06(2)).

Is it better to sell a Madison rental vacant or occupied?

Vacant usually reaches more buyers, including owner-occupants. Occupied appeals to investors and keeps rent coming in while you sell. Compare both nets before deciding.
